Implied Consent in Tennessee DUI Cases

In Tennessee, implied consent is a legal doctrine that automatically applies to any person who operates a motor vehicle on public roads within the state. In choosing to drive, an individual is deemed to have given implied consent to chemical testing of their breath, blood, or other bodily substances when lawfully arrested for driving under the influence (see Tennessee Code § 55-10-406(d)). 

This means that if a law enforcement officer has probable cause to believe a driver is intoxicated, the driver is legally obligated to submit to chemical testing to determine blood alcohol concentration or the presence of drugs. If a driver refuses to submit to these tests, there are significant legal consequences. The court will suspend the driver's license, and depending on the individual's prior criminal history, the driver may be required to install and use an ignition interlock device if ultimately convicted of driving under the influence. 

However, it is critical to note that for these consequences to be enforceable, the driver must be explicitly advised of the potential ramifications of test refusal. If the driver is not properly informed about the consequences of refusing breath or blood tests, the court loses its authority to impose these penalties. This safeguard ensures that drivers are fully aware of their rights and potential legal consequences before being penalized for test refusal.
